Burton<br \/>\n<strong>Citation: <\/strong>\u00a0491 P.2d 793 (1971)<\/p>\n<p><strong>\u00a0Facts: <\/strong>Burton was committing the felony of armed robbery, during which he killed someone. He was arrested and charged with <em>murder<\/em>. At Trial, the Judge instructed the jury that they could find Burton guilty of <em>first-degree murder<\/em> if they found that the death happened as a result of the robbery, even if that death was unintentional.<\/p>\n<p><strong>State\u2019s argument: <\/strong>The <a title=\"Doctrine of Felony-Murder\" href=\"http:\/\/www.miblaw.com\/lawschool\/felony-murder\/\">doctrine of felony-murder<\/a> applies because armed robbery is inherently dangerous to life.<\/p>\n<p><strong>Defendant\u2019s argument: <\/strong>An independent felonious purpose does not exist between the murder and the armed robbery.<\/p>\n<p><strong>Holding: <\/strong>An independent felonious purpose does exist and the defendant can be charged with felony-murder.<\/p>\n<p><strong>Reasoning: <\/strong>We look at the mind (<a title=\"Mens Rea\" href=\"http:\/\/www.miblaw.com\/lawschool\/mens-rea\/\"><em>mens rea<\/em><\/a>) of the defendant committing the crime.
