United States<br \/>\n<strong>Citation: <\/strong>283 U.S. 25 (1931)<\/p>\n<p><strong>Facts:<\/strong> McBoyle was convicted of knowingly transporting a stolen aircraft in interstate commerce.<\/p>\n<p><strong>Issue: <\/strong>Whether the term \u201cvehicle\u201d in the NMVTA applies to aircraft.<\/p>\n<p><strong>Defendant\u2019s argument: <\/strong>The definition of \u201cvehicle\u201d in the act specifies many land vehicles but does not mention anything about aircraft. There is nothing in the legislative history that mentioned aircraft.<\/p>\n<p><strong>State\u2019s argument: <\/strong>The definition includes \u201cany other self-propelled vehicle not designed for running on rails.\u201d An aircraft meets this definition.<\/p>\n<p><strong>Court\u2019s reasoning: <\/strong>Although a criminal is not likely to carefully consider the text of the law before committing a crime, the law should give reasonable fair warning (notice) and be written in language that the common world will understand. In everyday speech, the term \u201cvehicle\u201d conjures up the \u201cpicture of a thing moving on land.\u201d Also, the definitions only list motor vehicles that move on land.<\/p>\n<p><strong>Judgment: <\/strong>Reversed.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Case Name: McBoyle v.
