{"id":529,"date":"2011-08-17T00:19:39","date_gmt":"2011-08-17T04:19:39","guid":{"rendered":"http:\/\/www.miblaw.com\/lawschool\/?p=529"},"modified":"2011-08-17T00:15:31","modified_gmt":"2011-08-17T04:15:31","slug":"article-2-constitution","status":"publish","type":"post","link":"http:\/\/www.miblaw.com\/lawschool\/article-2-constitution\/","title":{"rendered":"Article 2"},"content":{"rendered":"<pre>Section 1\r\nThe executive Power shall be vested in a President of the United States of\r\nAmerica. He shall hold his Office during the Term of four Years, and, together\r\nwith the Vice-President chosen for the same Term, be elected, as follows:\r\n\r\nEach State shall appoint, in such Manner as the Legislature thereof may direct,\r\na Number of Electors, equal to the whole Number of Senators and Representatives\r\nto which the State may be entitled in the Congress: but no Senator or\r\nRepresentative, or Person holding an Office of Trust or Profit under the United\r\nStates, shall be appointed an Elector.\r\n\r\nThe Electors shall meet in their respective States, and vote by Ballot for two\r\npersons, of whom one at least shall not lie an Inhabitant of the same State\r\nwith themselves. And they shall make a List of all the Persons voted for, and\r\nof the Number of Votes for each; which List they shall sign and certify, and\r\ntransmit sealed to the Seat of the Government of the United States, directed to\r\nthe President of the Senate. The President of the Senate shall, in the Presence\r\nof the Senate and House of Representatives, open all the Certificates, and the\r\nVotes shall then be counted. The Person having the greatest Number of Votes\r\nshall be the President, if such Number be a Majority of the whole Number of\r\nElectors appointed; and if there be more than one who have such Majority, and\r\nhave an equal Number of Votes, then the House of Representatives shall\r\nimmediately choose by Ballot one of them for President; and if no Person have a\r\nMajority, then from the five highest on the List the said House shall in like\r\nManner choose the President. But in choosing the President, the Votes shall be\r\ntaken by States, the Representation from each State having one Vote; a quorum\r\nfor this Purpose shall consist of a Member or Members from two-thirds of the\r\nStates, and a Majority of all the States shall be necessary to a Choice. In\r\nevery Case, after the Choice of the President, the Person having the greatest\r\nNumber of Votes of the Electors shall be the Vice President. But if there\r\nshould remain two or more who have equal Votes, the Senate shall choose from\r\nthem by Ballot the Vice-President.\r\n\r\nThe Congress may determine the Time of choosing the Electors, and the Day on\r\nwhich they shall give their Votes; which Day shall be the same throughout the\r\nUnited States.\r\n\r\nNo person except a natural born Citizen, or a Citizen of the United States, at\r\nthe time of the Adoption of this Constitution, shall be eligible to the Office\r\nof President; neither shall any Person be eligible to that Office who shall not\r\nhave attained to the Age of thirty-five Years, and been fourteen Years a\r\nResident within the United States.\r\n\r\nIn Case of the Removal of the President from Office, or of his Death,\r\nResignation, or Inability to discharge the Powers and Duties of the said\r\nOffice, the same shall devolve on the Vice President, and the Congress may by\r\nLaw provide for the Case of Removal, Death, Resignation or Inability, both of\r\nthe President and Vice President, declaring what Officer shall then act as\r\nPresident, and such Officer shall act accordingly, until the Disability be\r\nremoved, or a President shall be elected.\r\n\r\nThe President shall, at stated Times, receive for his Services, a Compensation,\r\nwhich shall neither be increased nor diminished during the Period for which he\r\nshall have been elected, and he shall not receive within that Period any other\r\nEmolument from the United States, or any of them.\r\n\r\nBefore he enter on the Execution of his Office, he shall take the following\r\nOath or Affirmation:\r\n\r\n\"I do solemnly swear (or affirm) that I will faithfully execute the Office of\r\nPresident of the United States, and will to the best of my Ability, preserve,\r\nprotect and defend the Constitution of the United States.\"\r\n\r\nSection 2\r\nThe President shall be Commander in Chief of the Army and Navy of the United\r\nStates, and of the Militia of the several States, when called into the actual\r\nService of the United States; he may require the Opinion, in writing, of the\r\nprincipal Officer in each of the executive Departments, upon any subject\r\nrelating to the Duties of their respective Offices, and he shall have Power to\r\nGrant Reprieves and Pardons for Offenses against the United States, except in\r\nCases of Impeachment.\r\n\r\nHe shall have Power, by and with the Advice and Consent of the Senate, to make\r\nTreaties, provided two thirds of the Senators present concur; and he shall\r\nnominate, and by and with the Advice and Consent of the Senate, shall appoint\r\nAmbassadors, other public Ministers and Consuls, Judges of the supreme Court,\r\nand all other Officers of the United States, whose Appointments are not herein\r\notherwise provided for, and which shall be established by Law: but the Congress\r\nmay by Law vest the Appointment of such inferior Officers, as they think\r\nproper, in the President alone, in the Courts of Law, or in the Heads of\r\nDepartments.\r\n\r\nThe President shall have Power to fill up all Vacancies that may happen during\r\nthe Recess of the Senate, by granting Commissions which shall expire at the End\r\nof their next Session.\r\n\r\nSection 3\r\nHe shall from time to time give to the Congress Information of the State of the\r\nUnion, and recommend to their Consideration such Measures as he shall judge\r\nnecessary and expedient; he may, on extraordinary Occasions, convene both\r\nHouses, or either of them, and in Case of Disagreement between them, with\r\nRespect to the Time of Adjournment, he may adjourn them to such Time as he\r\nshall think proper; he shall receive Ambassadors and other public Ministers; he\r\nshall take Care that the Laws be faithfully executed, and shall Commission all\r\nthe Officers of the United States.\r\n\r\nSection 4\r\nThe President, Vice President and all civil Officers of the United States,\r\nshall be removed from Office on Impeachment for, and Conviction of, Treason,\r\nBribery, or other high Crimes and Misdemeanors.<\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Section 1 The executive Power shall be vested in a President of the United States of America.
